Terms of Use

Welcome to the Bildirsene mobile application ("App", "Service"). These Terms of Use ("Terms") govern your use of the Service provided by Bildirsene ("we", "us", "our").

By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Service Description

Bildirsene is a mobile application that allows citizens to report issues, suggestions, and observations in their cities with photos and descriptions, view these reports on a map, and tag relevant public institutions.

2. Account Creation

2.1 Age Requirement

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent to use the App.

2.2 Account Information

  • You must provide accurate, current, and complete information when creating an account
  • You are responsible for keeping your account information up to date
  • You are responsible for maintaining account security
  • You are responsible for all activities that occur under your account
  • You must immediately notify us of any unauthorized use of your account

2.3 Account Types

  • Email/Password: Direct registration
  • Google Sign In: Sign in with Google account
  • Apple Sign In: Sign in with Apple ID

3. Acceptable Use

3.1 Permitted Uses

You may use the App to:

  • Report issues you observe in your city
  • Share improvement suggestions
  • View other citizens' reports
  • Comment and interact with reports
  • Tag relevant public institutions

3.2 Prohibited Conduct

The following conduct is strictly prohibited:

Content Violations

  • Sharing offensive, profane, or degrading content
  • Sharing racist, sexist, or discriminatory content
  • Violent, obscene, or pornographic content
  • False, misleading, or intentionally incorrect information
  • Copyright infringement (photos belonging to others)
  • Invasion of privacy
  • Unauthorized sharing of personal information (doxxing)

System Violations

  • Reverse engineering the App
  • Exploiting security vulnerabilities
  • Using spam or automated bots
  • Unauthorized access to other users' accounts
  • Overloading or disrupting the Service

Misuse

  • Creating fake reports
  • Commercial advertising or promotion
  • Political propaganda
  • Inciting public disorder
  • Encouraging illegal activities

3.3 Content Moderation

  • We reserve the right to moderate published content
  • We may remove content that violates these Terms without notice
  • We reserve the right to terminate accounts for repeated violations

4. User Content

4.1 Content Ownership

  • You own the content you create (reports, comments, photos)
  • By sharing your content, you grant us the following rights:

4.2 License

You grant us a license to:

  • Display your content in the App
  • Provide access to other users
  • Display on the map
  • Send notifications (new comments, etc.)
  • Perform statistical analysis
  • Use for improvements

This license is free, worldwide, non-exclusive, transferable, and sublicensable.

4.3 Content Responsibility

  • You are legally responsible for the content you share
  • You warrant that your content does not infringe third-party rights
  • You represent that your content is accurate and true

4.4 Content Deletion

  • You can delete your content at any time
  • Deleted content is permanently removed from backups within 30 days
  • However, if your content has been quoted or shared by others, we have no control over those copies

5. Intellectual Property Rights

5.1 App Ownership

  • All rights to the App (design, code, logo, brand) belong to us
  • These Terms do not grant you any intellectual property rights
  • "Bildirsene" name and logo are our registered trademarks

5.2 Third-Party Rights

Third-party libraries and services used in the App:

  • Supabase (MIT License)
  • React Native (MIT License)
  • Expo (MIT License)
  • Firebase Analytics (Google Terms)
  • Sentry (BSD License)

6. Service Availability

6.1 Service Changes

  • We reserve the right to modify, suspend, or terminate the Service at any time
  • Significant changes will be notified in advance (when possible)
  • Temporary interruptions may occur for maintenance

6.2 Access Restrictions

We may restrict your access in the following situations:

  • Violation of these Terms
  • Legal obligation
  • Security threat
  • Threatening service stability

6.3 Disclaimer of Warranties

The Service is provided "as is". We do not warrant:

  • Uninterrupted or error-free operation
  • Fitness for a particular purpose
  • Accuracy of content
  • Absence of security vulnerabilities

7. Limitation of Liability

7.1 General Liability

To the extent permitted by law:

  • We are not liable for indirect, incidental, or special damages arising from Service use
  • Our maximum liability is limited to fees paid by you in the last 6 months (if the Service is free: $100 USD)

7.2 Content Liability

  • We are not responsible for the accuracy of user content
  • We are not responsible for disputes between users
  • We are not responsible for third-party links

7.3 Exceptions

The following are not included in the liability limitation:

  • Intentional misconduct
  • Gross negligence
  • Liabilities that cannot be legally limited

8. Account Termination

8.1 By You

  • You can delete your account at any time
  • Use Settings > Delete Account option
  • Account deletion is irreversible

8.2 By Us

We may terminate your account in the following situations:

  • Serious violation of these Terms
  • Legal obligation
  • Repeated complaints
  • Long-term inactivity (2+ years)

Upon account termination:

  • Your personal data is deleted
  • Your reports continue to appear as an anonymous user

9. Indemnification

You agree to indemnify us against all claims, damages, and costs arising from:

  • Your violation of these Terms
  • Content you share
  • Your infringement of third-party rights
  • Your violation of laws

10. Governing Law and Jurisdiction

10.1 Applicable Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey.

10.2 Jurisdiction

Istanbul Courts and Execution Offices have jurisdiction over disputes arising from these Terms.

10.3 Consumer Rights

Your rights under Consumer Protection Law are reserved.

11. General Provisions

11.1 Changes

  • We may modify these Terms at any time
  • Significant changes will be notified 30 days in advance
  • Continuing to use the Service after changes constitutes acceptance of the new Terms

11.2 Waiver

  • Our failure to exercise any right does not constitute a waiver of that right
  • Enforcing a provision does not mean we will always enforce it

11.3 Severability

If any provision of these Terms is deemed invalid, the remaining provisions remain in effect.

11.4 Assignment

  • You may not assign your rights and obligations under these Terms
  • We may assign our rights to any third party

11.5 Entire Agreement

These Terms constitute the entire agreement between you and us regarding Service use.

These Terms of Use have been prepared in accordance with applicable laws, including Turkish consumer protection legislation and internet content regulation.
